These terms of use govern the rights and obligations of the users of the portal (hereinafter referred to as \"users\") when using the portal and all other services provided by B\u00e9ton Capital in connection with the portal.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"18\" data-lineheight=\"27px\">1 - Offer and use<\/h2>\n<p>On the portal, B\u00e9ton Capital publishes information on financial and insurance products, in particular comparisons of services and prices (hereinafter referred to as the \"Information\") and offers technical advice and the transfer of such advice and other financial and insurance products requested by users (hereinafter referred to as \"advice and transfer\", together hereinafter referred to as the \"Offer\"). The Offer does not represent an invitation or recommendation to purchase or otherwise acquire any service or goods and is without obligation to Users.<\/p>\n<p>The offer is aimed exclusively at natural persons in full possession of their means residing in Switzerland and is made available to them free of charge and without obligation for private use. Any use by legal entities or for commercial purposes is prohibited. Users waive any claim to commissions and other remuneration from consultancy and forwarding as well as from third parties for the benefit of B\u00e9ton Capital in connection with the offer.<\/p>\n<p>Users have no claim to the use of the portal and may be excluded at any time and without justification from the use of the portal by B\u00e9ton Capital, either temporarily or permanently. Insofar as user data is required for the use of the offer, users undertake to provide B\u00e9ton Capital exclusively with correct and complete data. In the event of incorrect or incomplete data, users are fully liable for any resulting damage to B\u00e9ton Capital.<\/p>\n<p>Third parties whose advice and transmission is provided to users by B\u00e9ton Capital (hereinafter the \"advisors and intermediaries\") are obliged in particular to carry out their advice and transmission to users at all times with the utmost care and professionalism and to comply with applicable Swiss law and applicable professional, supplier- and industry-specific recommendations, guidelines and other provisions. Users for whom no advice or transmission is possible must be redirected by the relevant advisors and intermediaries to alternative advice and transmission solutions, including direct and (where applicable) free advice and acquisition solutions from the respective providers of the desired financial and insurance products.<\/p>\n<p>B\u00e9ton Capital receives information on the quality of the offer - for example in relation to advisors and intermediaries - at any time by e-mail to info@Beton-Capital.com.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"18\" data-lineheight=\"27px\">3 - Liability<\/h2>\n<p>Any liability on the part of B\u00e9ton Capital for direct damage resulting from the offer and the portal is expressly excluded, subject to mandatory statutory provisions. Any liability on the part of B\u00e9ton Capital for indirect or consequential damage resulting from the offer and the portal is expressly excluded. In particular, B\u00e9ton Capital accepts no liability for damage caused by advisors and intermediaries or for information, portal failures, breakdowns at agents and other third parties or errors in the transmission of electronic messages.<\/p>\n<p>The availability of the portal may be partially or totally limited at any time, without justification. B\u00e9ton Capital accepts no responsibility for the temporary unavailability of the portal as a whole or of some of its functions, or for errors in individual functions of the portal.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"18\" data-lineheight=\"27px\">4 - Data protection<\/h2>\n<p>B\u00e9ton Capital is subject to Swiss data protection law and in principle stores personal and other data on servers in Switzerland. In particular, B\u00e9ton Capital collects and processes data that users transmit to B\u00e9ton Capital via forms directly on the portal, applications linked to the portal or in any other way. This data includes, for example, names, postal addresses, e-mail addresses, telephone numbers, dates of birth, gender, family relationships and wishes relating to financial and insurance products. Other data such as date and time stamps, IP addresses used, browser and operating systems used and, where applicable, details of location disclosed are transmitted to B\u00e9ton Capital during use.<\/p>\n<p>B\u00e9ton Capital may use all data collected for any purpose in connection with the operation of the portal and the offer and has the right to retain all data for ten years. An invalid or void provision must be replaced by a legally permissible provision that corresponds as closely as possible to the original economic purpose.<\/p>\n<p>Use of the portal is subject exclusively and in its entirety to Swiss law.
