Terms and conditions of use

The company Béton Capital, based in Geneva, Switzerland (hereinafter referred to as "Béton Capital"), operates the Internet portal "Beton-Capital.com" (hereinafter referred to as the "Portal"). These terms of use govern the rights and obligations of the users of the portal (hereinafter referred to as "users") when using the portal and all other services provided by Béton Capital in connection with the portal.

1 - Offer and use

On the portal, Béton Capital publishes information on financial and insurance products, in particular comparisons of services and prices (hereinafter referred to as the "Information") and offers technical advice and the transfer of such advice and other financial and insurance products requested by users (hereinafter referred to as "advice and transfer", together hereinafter referred to as the "Offer"). The Offer does not represent an invitation or recommendation to purchase or otherwise acquire any service or goods and is without obligation to Users.

The offer is aimed exclusively at natural persons in full possession of their means residing in Switzerland and is made available to them free of charge and without obligation for private use. Any use by legal entities or for commercial purposes is prohibited. Users waive any claim to commissions and other remuneration from consultancy and forwarding as well as from third parties for the benefit of Béton Capital in connection with the offer.

Users have no claim to the use of the portal and may be excluded at any time and without justification from the use of the portal by Béton Capital, either temporarily or permanently. Use of the portal in a way that could compromise its correct operation is prohibited. Users must refrain from any misuse of the portal, in particular automated use using software other than that of the portal.

2 - Quality

Béton Capital endeavours to ensure the best possible quality of the offer, but expressly refrains from any direct or indirect guarantee and assurance of the quality of the offer, for example with regard to the topicality, accuracy and completeness of the information. Insofar as user data is required for the use of the offer, users undertake to provide Béton Capital exclusively with correct and complete data. In the event of incorrect or incomplete data, users are fully liable for any resulting damage to Béton Capital.

Third parties whose advice and transmission is provided to users by Béton Capital (hereinafter the "advisors and intermediaries") are obliged in particular to carry out their advice and transmission to users at all times with the utmost care and professionalism and to comply with applicable Swiss law and applicable professional, supplier- and industry-specific recommendations, guidelines and other provisions. Users for whom no advice or transmission is possible must be redirected by the relevant advisors and intermediaries to alternative advice and transmission solutions, including direct and (where applicable) free advice and acquisition solutions from the respective providers of the desired financial and insurance products.

3 - Liability

Any liability on the part of Béton Capital for direct damage resulting from the offer and the portal is expressly excluded, subject to mandatory statutory provisions. Any liability on the part of Béton Capital for indirect or consequential damage resulting from the offer and the portal is expressly excluded. In particular, Béton Capital accepts no liability for damage caused by advisors and intermediaries or for information, portal failures, breakdowns at agents and other third parties or errors in the transmission of electronic messages.

The availability of the portal may be partially or totally limited at any time, without justification. Béton Capital accepts no responsibility for the temporary unavailability of the portal as a whole or of some of its functions, or for errors in individual functions of the portal.

4 - Data protection

Béton Capital is subject to Swiss data protection law and in principle stores personal and other data on servers in Switzerland. In particular, Béton Capital collects and processes data that users transmit to Béton Capital via forms directly on the portal, applications linked to the portal or in any other way. This data includes, for example, names, postal addresses, e-mail addresses, telephone numbers, dates of birth, gender, family relationships and wishes relating to financial and insurance products. Other data such as date and time stamps, IP addresses used, browser and operating systems used and, where applicable, details of location disclosed are transmitted to Béton Capital during use.

Béton Capital may use all data collected for any purpose in connection with the operation of the portal and the offer and has the right to retain all data for ten years. Béton Capital takes appropriate measures to protect such data. Users who receive information and advice from Béton Capital via the portal expressly agree that the data collected and processed by Béton Capital for this purpose may be passed on to advisors and intermediaries. Advisors and intermediaries are obliged to comply fully with the Swiss Data Protection Act at all times.

Béton Capital is entitled to transmit personal data and other data to third parties or to have such data transmitted by third parties in connection with the transmission or exercise of rights and obligations under these Terms of Use and in connection with the operation of the portal. If data is transferred abroad, Béton Capital takes appropriate measures to ensure that the standard of data protection corresponds to that in Switzerland.

Béton Capital may use the services of third parties in Switzerland and abroad, in particular the "Google Analytics" and "Google AdSense" services of the American company Google Inc. When these services are used, the IP addresses, cookies and other data - which may include personal data - of users relating to their use of the portal may be transmitted to third parties abroad and from there to countries where data protection standards may not correspond to those in Switzerland.

5 - Other provisions

By using the portal, users acknowledge these conditions of use. Béton Capital may supplement or otherwise amend these Terms of Use at any time and without giving reasons. The current terms of use published on the portal apply. If users do not agree to a change in these terms of use, continued use of the portal is not permitted.

If individual provisions of these terms of use are invalid or void, this shall not affect the validity of the remaining provisions of these terms of use. An invalid or void provision must be replaced by a legally permissible provision that corresponds as closely as possible to the original economic purpose.

Use of the portal is subject exclusively and in its entirety to Swiss law. The exclusive place of jurisdiction is Geneva, Switzerland.
